ANJANA MISHRA ORAL ORDER 29-07-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Ziradei P. S. Case No. 90 of 2015 registered for the offence punishable under Section 406 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner was not posted during the relevant period, the information sought in the year 2015 was not supplied by him and the petitioner was sought to be prosecuted in connection with non-supply of the certain information which had been asked under the R.T.I, Act. It is further submitted that he has been posted in the concerned Panchayat only between the period from
Patna High Court Cr.Misc. No.30456 of 2016 (2) dt.29-07-2016 2/2 August, 2012 to March, 2013 and therefore, he was not responsible for any such inaction.
Considering the nature of allegation levelled against the petitioner which is vague and misleading, let the petitioner, in the event of his arrest/surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Siwan in connection with Ziradei P. S. Case No. 90 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Anjana Mishra, J.) Mishra/- U T
