JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-11-2018 The petitioner seeks regular bail in connection with Assaon P.S. Case No. 58 of 2018, registered for offences punishable under Sections 457 and 380 of the Indian Penal Code.

Allegation is of commission of theft of Idols made of Astadhatu.

It has been submitted on behalf of the petitioner that the recovery has been made from one Manish Kumar Singh, Son of Motilal Singh and not from the petitioner and though it is alleged that petitioner and other two co-accused were coming from motorcycle and from there also two idols were recovered, however, one of the co-accused, who was also riding on the said motorcycle has already been enlarged on bail by

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Assaon P.S. Case No. 58 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and shall make himself present as and when required by the court, otherwise, his bail bonds shall be cancelled.
