JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The petitioner seeks regular bail in connection with Sonbarsa P.S. Case No. 128 of 2017, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 189 litres of liquor from the vehicle on which the petitioner was traveling. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from his conscious possession and though he is an accused in two other cases but he is on bail in those cases. In this case he has been in judicial custody since 11.07.2017. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.37991 of 2017 (4) dt.24-08-2017 circumstances of the case and also that petitioner has criminal antecedents as he is an accused in two similar type of cases, as such, this application is disposed of with direction to the court below to conclude the trial within a period of six months and if the trial is not concluded within the aforesaid period, the court below shall release the petitioner on bail to his own satisfaction.
