The petitioner apprehends his arrest in connection with Gogri (Paura) P.S. Case No. 284 of 2021 registered under Sections 409 and 420 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has falsely been implicated in this case due to enmity. In the meeting of Gram Sabha, decision was taken for installation of 227 street lights, tender was invited and contract was awarded to M/s Akshay Urja Jan Jagran Samiti, Begusarai and accordingly, work order was

Patna High Court CR. MISC. No.51625 of 2021(2) dt.12-04-2022 2/2 issued. Further he submits that petitioner is the Panchayat Secretary. From perusal of the materials available on record, it is crystal clear that the government money was not entrusted to the petitioner nor any government money was defalcated by this petitioner.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Khagaria in connection with Gogri (Paura) P.S. Case No. 284 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
