Petitioners are apprehending their arrest in connection with a case registered for the offence under Section 308 and other allied sections of the Indian Penal Code. They are said to be the members of a mob, which was protesting the murder of one Baleshwar Mahto, who was killed by unknown criminals. It is submitted on behalf of the petitioners that unknown member of the mob hurled stones causing injuries to the

No.41396 of 2015 (2) dt.15-10-2015 2/2 police party and as petitioners and others were prominent person of the locality, they have been named as accused because they were identified by the informant, ASI with the help of Chawkidar. The injury report was not made available to the learned Sessions Judge, which fact is evident from the impugned order. Let petitioners above named surrender in the court below within four weeks from the date of receipt/ production of a copy of this order in the court below and thereafter they be admitted to the privilege of bail on furnishing bail bonds of Rs. 5,000/- (Rs. Five thousand only) each with two sureties of the like amount each to the satisfaction of C.J.M., Samastipur in connection with Musharigharari P.S. Case No. 128 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
