The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.

The F.I.R. was lodged against unknown on missing of the daughter of the informant. The daughter of the informant had gone along with co-accused, Priya Devi. Priya Devi stated before the Police that on call by the petitioner, she and the victim had gone to Delhi. However, petitioner did not come on the railway station to receive them. Thereafter, the victim expressed her desire to be in Delhi and Priya Devi returned.

By order dated 05.11.2018, the petitioner was directed to appear before the Superintendent of Police, Nalanda to co-operate

Patna High Court Cr.Misc. No.53768 of 2018(5) dt.06-12-2018 2/2 in the investigation for the reason that Superintendent of Police, Nalanda had reported that petitioner was not co-operating. Petitioner has filed supplementary affidavit stating therein that he has already appeared before the Superintendent of Police, Nalanda and provided his contact number along with his father's name and he is ready to appear, whenever required by the Police.

Considering the fact that there is no substantial material against the petitioner for the present, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Giriyak (Katrisarai) Police Station Case No.254 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
