The petitioners apprehend their arrest in connection with Kasichak P. S. Case No. 65 of 2018 registered for the offences punishable under Sections 366, 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioner no. 1 is the father of the boy who is said to have taken away the daughter of the informant. So far as petitioner no. 2 is concerned, she happens to be the married daughter of petitioner no.
1. It is submitted that as per allegations, the petitioners have taken away the daughter of the informant on the pretext of attending the marriage ceremony but thereafter, the daughter of the informant did not return.
Learned counsel submits that so far as these two
Patna High Court Cr.Misc. No.54607 of 2018(4) dt.15-01-2019 2/2 petitioners are concerned, they have no role to play and both the boy as well as the daughter of the informant are adult. Learned counsel for the State is present and has opposed the prayer of bail.
In the given facts and circumstance of the case where it appears that the petitioner nos. 1 and 2 are the father and married sister of the boy who has allegedly taken away the daughter of the informant for marriage and then both the boy as well as the daughter of the informant are adult, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, let petitioners above named be enlarged on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Nawada in connection with Kashichak P. S. Case No. 65 of 2018, subject to the condition that the petitioner nos. 1 and 2 shall join the investigation within a period of three weeks from today by reporting to the Investigating Officer and shall co-operate in the matter of investigation and it will be in addition to the conditions prescribed under Section 438 (2) of the Cr.P.C.
