2. It transpires from the Office notes that notice has been duly received by the father of the Opposite Party No. 2, as such, notice is treated to be validly served.
3. The petitioner seeks regular bail in connection with Complaint Case No. 236 of 2013 lodged under Sections 498A, 379, 380, 323, 504 of the I.P.C. and Section 3 and 4 of the Dowry Prohibition Act.
4. Upon perusal of records, it transpires to this Court that case has been lodge under above said provision but
Patna High Court CR. MISC. No.43626 of 2023(6) dt.07-03-2024 2/2 cognizance has been taken under section 498A of the I.P.C. and section 3 and 4 of the D.P. Act. . Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 23.05.2023 having no criminal case pending against him. It has been specifically pleaded in Paragraph 9 of the bail application that he is ready to keep his wife with full respect and integrity
5. Learned counsel for the State opposes the prayer for bail but submits that petitioner is aged about 50 years.
6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Aurungabad in connection with Complaint Case No. 236 of 2013, subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
