Petitioner prays for bail in connection with Pero (Hassanbazaar) P.S.Case No. 117 of 2018 registered for the offences punishable under Sections 364 and subsequently Sections 302, 201 and 120B of the Indian Penal Code were added.
Allegation as per FIR is that deceased husband of the informant was taken by Vinod Singh and Kameshwar Singh on the pretext of purchasing of buffalo and he did not return and later on his dead body was recovered. Petitioner is not named in the FIR and later on his name transpired during course of investigation.
Submission of learned counsel for the petitioner is
Patna High Court Cr.Misc. No.52254 of 2018(3) dt.29-10-2018 2/2 that except confessional statement of co-accused there is nothing against him and he is in custody since 29.6.2018. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bhojpur at Ara, in connection with Pero (Hassanbazaar) P.S.Case No. 117 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
