The petitioner, invoking writ jurisdiction of this Court under Article 226 of the Constitution of India, has prayed for directing the respondent no.4/ Divisional Forest Officer, Rohtas at Sasaram to provisionally release the truck, bearing Registration No.BR-1GB/9946, which has been seized on 17.08.2015 on allegation of commission of forest offence.
Learned counsel for the petitioner accepts that confiscation case vide Confiscation Case no. 164 of 2015 has already been initiated.
In view of the fact that the vehicle in question was
Patna High Court CWJC No.15678 of 2015 (2) dt.05-10-2015 2/2 recently seized on 17.08.2015 and confiscation proceeding has already been initiated, there is no reason to pass any order for provisional release of the vehicle in question. The writ petition stands dismissed.
