Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 23.6.2017 passed in Cr. Appeal (SJ) No.844 of 2017.

Allegation against the appellant is of committing rape upon the informant, who is minor girl.

Submission of the learned counsel for the appellant is that he is in custody for 2 years and 5 months and the medical report does not support the allegation. .

Heard learned A.P.P. and perused the report, from which it appears that two witnesses have been examined in this case. .

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined go grant bail to

Patna High Court CR. APP (SJ) No.3156 of 2018(5) dt.16-01-2019 2/2 the appellant, hence this appeal is dismissed, however, the learned trial court is directed to expedite the trial. With the aforesaid observation, this application is dismissed.
