Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 448, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged in the F.I.R that this petitioner

No.38775 of 2020(2) dt.21-10-2021 2/3 along with other co-accused armed with pistol came at the door of the informant when it is alleged that coaccused Vijay Paswan caught hold the hand of daughterin-law of the informant and ordered to kill upon which, co-accused Deepak Paswan fired from his pistol which hit on the leg of the daughter-in-law of the informant. On raising alarm, the accused persons started fleeing away from the place of occurece and threatened of dire consequences if any complaint is made before the police. It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. There is no specific allegation of any overt act against the petitioner and the petitioner has clean antecedent. Moreover, a compromise petition has also been filed before learned Court below, a copy of which has been produced before this court through supplementary affidavit.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or

No.38775 of 2020(2) dt.21-10-2021 3/3 surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Munger in connection with Bariarpur P.S. Case No. 33 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
