The petitioner is apprehending arrest in a case registered for the offences punishable under sections 364A/34 of the Indian Penal Code and section 27 of the Arms Act. The accusation is of abducting the son of the informant. The FIR was lodged against unknown. The name of the petitioner sprang up on the confession of co accused Mithilesh Rai.

It is submitted by the learned counsel for the petitioner that the victim boy in his 164 Cr.P.C. statement has not named the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.49598 of 2015 (2) dt.05-11-2015 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Ahiapur P.S. Case No. 433 of 2010 (S.T. No. 491 of 2013) pending in the court of learned 6th Addl. Sessions Judge, Muzaffarpur.

This application is disposed of with the aforesaid observation/direction.
