22-01-2015 On call, none appeared on behalf of petitioner either to press the petition or to make a prayer for adjournment. Learned counsel for Patna Municipal Corporation is present. He submits that in compliance of the order dated 05-12-2014, a detailed supplementary show cause has already been filed and plausible explanation has been given regarding delayed compliance of the order of the writ court.
Ofcourse, in compliance with the order of the writ court, a speaking order has been passed by the Municipal Commissioner, but since delay has occurred, the Municipal Commissioner was directed to file specific explanation. In
Patna High Court MJC No.6152 of 2013 (6) dt.22-01-2015 2/2 compliance with earlier order, supplementary show cause has been filed and plausible explanation has been given regarding delayed compliance and since order of the writ court has already been complied with and delay has been explained, there is no reason to keep the matter pending. If the petitioner feels aggrieved with the order i.e. Annexure 'A' passed by the Municipal Commissioner, he would be at liberty to assail the same in appropriate proceeding. The petition stands disposed of.
