The petitioner seeks bail in Dandari P.S. Case No. 77/2017, instituted for the offences under Sections 307, 324 and 34 of the Indian Penal Code read with Section 27 of Arms Act. It is alleged in the written report that on the date of occurrence, when the informant was returning from his field and as he reached near his house, he saw the accused persons armed with Katta. It is further alleged that Bisheshwar Yadav fired in the air. Thereafter from the front the petitioner fired at the informant, which hit his Panjara. It is further alleged that Pankaj Yadav fired from his katta, which hit the left arm of informant. Cause of occurrence is land dispute.

Patna High Court Cr.Misc. No.53930 of 2018 (5) dt.02-11-2018 2/2 Injury report of the informant is available in case diary, wherein doctor has found entry wound in left arm and in chest region. One exit wound is also found on the left arm of the informant. One bullet has also been removed after thoractomy. Injuries are opined to be grievous in nature. Injury report has been issued by P.H.C., Dandari.

Learned counsel for the petitioner has submitted that in the written report it is alleged that informant was taken to Begusarai for treatment but injury report has been issued from P.H.C., Dandari.

In the injury report, it is mentioned that informant was referred to Sadar Hospital, Begusarai.

In view of such, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.

Trial court is directed to expedite the trial. Petitioner is given liberty to renew his prayer for bail after six months in the event no substantive progress is made in trial.
