The petitioner seeks regular bail in connection with Special Case No.42 of 2017 arising out of Khushrupur P.S.case No.48 of 2017 registered for offences punishable under Sections 20/22 of N.D.P.S Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 300 gram of Ganja and 02 ltrs. of country made liquor from the possession of the petitioner.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. The petitioner has no criminal antecedent and he has remained in custody for 2 1⁄2 months.

Patna High Court Cr.Misc. No.47414 of 2017 (2) dt.12-10-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the learned trial court to verify about the criminal antecedent of the petitioner and if he has no criminal antecedent, the learned court below will release the petitioner in connection with Special Case No.42 of 2017 arising out of Khushrupur P.S.case No.48 of 2017 to his own satisfaction.
