JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 17-09-2018 Heard learned counsel for the petitioner as well as Additional Public Prosecutor.

There was commission of dacoity in the house of the informant whereupon, FIR has been registered against un-known. During course of investigation, it has been found that miscreants who were arrested by the Gopalpur police station had, during course of interrogation, made inculpatory extra judicial confessional statement (Para-69) whereupon, petitioner along with others got remanded in this case. It is also evident from Para 105 that victim is not interested to participate in the TIP. Accordingly, petitioner, Uttam Haldar, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
