The petitioner is languishing in custody since 18.01.2019 in a case for the offence registered under Sections 279 of the IPC, 20 and 22 of the N.D.P.S. Act. The prosecution story, in brief, is that on 18.11.2012 at about 7.45 A.M., the informant got information that at Nanosati Jagdishpur Pitch Road, one Bolero Jeep No. BR-05P3571 met with an accident. He alongwith police personnel reached at the place of occurrence. The people disclosed that the said Bolero Jeep was stopped near Sugar Cane field of Deep Mishra and the driver fled away from there. He made search of the said Bolero Jeep and found 140 Kg. Ganja in 14 bundles from the Jeep. He seized the said Jeep and Ganja and prepared the seizure list.
Patna High Court CR. MISC. No.38933 of 2019(2) dt.27-06-2019 2/2 It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. From an accidental Bolero vehicle, 140 Kg. of Ganja is said to have been recovered. After a period of four months, the name of the petitioner has come in the present case on the basis of disclosure made by the owner of Bolero vehicle stating that the petitioner is a driver of the vehicle in question. The petitioner has got no concern with the alleged vehicle. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, West Champaran, Bettiah, in connection with Majhaulia P.S. Case No. 389 of 2012 (N.D.P.S. Case No. 105 of 2012). (Sudhir Singh, J) U.K./- U T
