The petitioner seeks bail in anticipation of his arrest in connection with Gopalpur P.S. Case No. 46 of 2019, dated 14.02.2019, instituted for the offences under Sections 467, 468, 471 and 420/34 of the Indian Penal Code.
The accusation in the F.I.R., it has been averred, does not constitute any offence of any kind whatsoever. It merely states that the petitioner and others were trying to have a land notified in his favour.
The offence therefore remains inchoate.
Patna High Court CR. MISC. No.39281 of 2020(2) dt.07-12-2021 2/2 The learned counsel for the petitioner has intimated this Court that out of eight cases lodged against the petitioner, six have been lodged by the same person as informant.
Considering the vague nature of accusation in the F.I.R. and taking into account that one person has filed six cases against him and that in all cases in which the petitioner has earlier been made accused, he is on bail, he, in the event of his arrest or surrender before the learned Court below within a period of three weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubJudge-IX-Cum-ACJM-IX, Patna in connection with Gopalpur P.S. Case No. 46 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
