2. The petitioner seeks bail in Bhagwan Bazar P.S. Case No. 228 of 2024 registered for the offence punishable under Section-30(a) of Bihar Prohibition and Excise Act, 2016.
3. Allegedly, 110 litres of illicit liquor has been recovered from Basa of the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has also been submitted that no incriminating article has been recovered from conscious possession of the petitioner. The petitioner has no concern with the Basa wherefrom liquor is said to have been recovered. The petitioner
Patna High Court CR. MISC. No.52274 of 2024(3) dt.25-09-2024 2/2 is under incarceration since 02-05-2024.
5. Learned APP has opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Exclusive Special Judge, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 228 of 2024.
7. Before accepting the bail bonds, the criminal antecedent of the petitioner shall be verified and if, it is found that he is involved in any other case except the case(s), mentioned in paragraph-3 of the bail petition, his bail bonds shall not be accepted.
