JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Paraiya P. S. Case No. 95/2015 registered under Sections 147, 148, 323, 379, 353, 504 and 506 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that other co-accused, namely, Prem Chand Yadav @ Prem Chandra Yadav, Satyendra Yadav @ Satendra Yadav, Pintu Yadav @ Pintu Kumar, Santosh Yadav @ Santosh Kumar and Kedar Yadav having exactly identical allegation to that of the petitioner have already been granted privilege of pre-arrest bail by a co-ordinate Bench of this Court vide order dated 16.06.2016 passed in Cr. Misc. No. 24894 of 2016.

Regard being had to the reasons assigned in the aforesaid order dated 16.06.2016 passed in Cr. Misc. No. 24894 of 2016, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in Paraiya P. S. Case No. 95/2015 (G.R. No. 4801 of 2015), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J.) Kanchan/- U T
