Informant, who happens to be mother of the victim, aged about 7 Years had alleged that the petitioner had attempted to commit rape over her, which he could not, on account of alarm raised by the victim. Subsequently thereof, he had also given Rs.5/- in order to shut her mouth. Statement of victim has been recorded under Para-5 as well as her statement has also been recorded under Section 164 of the Cr.P.C. (Para-35) wherefrom, it is evident that petitioner had clawed her private part, whereupon she raised alarm. She was released having a coin of

Considering the allegation in consonance with the period of detention, petitioner, Dhan Babu Thakur is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1st-cumSpecial Judge, West Champaran at Bettiah in connection with Lauriya P. S. Case No.24 of 2017.
