Petitioner has filed this modification application for modification of order dated 02.05.2019 passed in Criminal Miscellaneous No. 28555 of 2019 whereby while allowing the anticipatory bail petition, the petitioner was directed to surrender before the learned lower Court within four weeks and furnish bail bond.

Learned counsel for the petitioner has sought extension of time for surrender before the learned lower Court submitting that the petitioner was suffering from Dengue fever in Kolkata hence he could not surrender before the learned

Patna High Court CR. MISC. No.40485 of 2019(2) dt.03-07-2019 2/2 lower Court in compliance of the order of this Court within stipulated period.

Having regard to the facts and circumstances of the case, petitioner is directed to surrender before the learned lower Court and furnish bail bond within four weeks from today. Accordingly, the order dated 02.05.2019 passed in Criminal Miscellaneous No. 28555 of 2019 is modified to the extent as indicate above and this application is disposed of.
