The petitioner has preferred this application for grant of regular bail in a case registered under sections 364A and 120B of the Indian Penal Code.

As per the prosecution case, information was received on telephone from the petitioner herein about the kidnapping of the son of the informant. Four accused persons were involved in the kidnapping. The informant suspected the hand of the petitioner also.

It is submitted by learned counsel for the petitioner that only a suspicion has been raised against the petitioner in the FIR as also in the statement under section 164 Cr.P.C.. No material has transpired in course of investigation to connect the

Patna High Court CR. MISC. No.53163 of 2021(3) dt.08-04-2022 2/2 petitioner with the alleged crime. The prosecution is mainly relying on the confessional statement made before police which is inadmissible. The petitioner is in custody since 28.4.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the material that has transpired in course of investigation together with the petitioner having remained in custody for 11 months and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Giriyak (Pawapuri) P.S. Case no. 178 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate III, Nalanda at Biharsharif.
