JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-07-2019 This is an application for grant of anticipatory bail in connection with Naubatpur P.S. Case No. 232 of 2019 (arising out of Special Case No. 3680 of 2019), disclosing offences under Sections 420, 188 of the Indian Penal Code and Sections 30(a), 38(i), 38(ii) of the Bihar Prohibition & Excise Act. F.I.R. disclosed recovery of huge quantity of liquor from a vacant land.

Submission of the learned counsel for the petitioner is that as a matter of fact, the vehicle met with an accident and due to that liquor was thrown in the vacant land. Petitioner has no criminal antecedent.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail as liquor was recovered from the land of the petitioner.

Having heard both sides, in view of the specific

No.40226 of 2019(2) dt.01-07-2019 2/2 allegation in the F.I.R. that same has been recovered from the land of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail which will be considered by the learned court below on its own merit, without being prejudiced by order of this Court, and if possible, be disposed of on the same day.
