The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 420/467/468/471/504/506 of the Indian Penal Code. Learned counsel for the petitioners submits that there is a title suit pending between the parties and the allegation of having sold the land which was not part of his share is entirely mischievous. He further alleges that if there was any dispute between the parties, it was open to them to have the title adjudicated in a court of competent jurisdiction. In view of the civil nature of dispute and that a title suit is also pending between the parties, let the petitioners above named,
Patna High Court Cr.Misc. No.32433 of 2016 (3) dt.09-01-2017 P2/2 in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 57/2016 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
