This application is for grant of regular bail in connection with Chainpur P.S.Case No.7 of 2017 , registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.
The petitioner is named in the F.I.R., however his name transpired during the course of investigation on the basis of confession of the co-accused.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case with respect to theft of 41 bags of paddy and nothing has been recovered from his possession. It is also submitted that though he is accused in five other cases but he is on bail in all those cases and they are of
Patna High Court Cr.Misc. No.39450 of 2017 (2) dt.22-08-2017 2/2 different nature except one.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances as well as considering criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner, as such this application is disposed of with direction to the learned trial court that once the charge is framed against this petitioner in this case or he completes judicial custody of six months period, whichever is earlier, he may be released on bail by the learned court below itself in connection with Chainpur P.S.Case No.7 of 2017 to the satisfaction of C.J.M., Kaimur at Bhabhua, on his own satisfaction.
With the aforesaid observation, this application is disposed of.
