The petitioner prays for anticipatory bail in a case registered under Sections 341, 323, 342, 354, 354(B)/34 of the Indian Penal Code and Section 3 (i) (xi) of the SC/ST (Prevention of Atrocities) Act.
It is submitted by learned counsel for the petitioner that the allegation regarding abusing by caste name is at the house of the informant during which the members of the family of the informant were present and thus the allegation under S.C./S.T. Act is not made out. It is further submitted that the petitioner has been falsely implicated in the present case on account of certain loan granted by the accused persons to the father of the informant and were insisting upon to refund of the money, and therefore a false case has been lodged. On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Anandi Pandey, in the event of his arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each in connection with Chakai P.S. Case No.68 of 2015 to the satisfaction of Sri Lalan Kumar, Judicial Magistrate, Ist Class, Jamui, subject to the other conditions as laid down under Section 438 (2) of the Cr. P.C.
