02. 31.08.2016 Heard parties.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 394, 412 and 395 of the Indian Penal Code and Sections 25(1-B) A and 26 of the Arms Act.

As per allegation, three persons who were involved in snatching, were apprehended by the Police. The FIR further shows that these three persons disclosed the name of another person who was also involved in the occurrence being Rakesh Kumar. However, the FIR does not disclose that the petitioner was also one of the persons involved as even the apprehended persons did not disclose his name. Later on, it appears that the

Patna High Court Cr.Misc. No.29683 of 2016 (2) dt.31-08-2016 confessional statements of the aforesaid accused were recorded by the Police in which they have taken the name of the petitioner. It is urged that the petitioner is having clean antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Krishna Kumar Sah be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Birpur P.S. Case No. 33/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Birpur, Supaul subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.

However, at the time of accepting bail bond, the court below will verify and ensure itself regarding the criminal antecedent of the petitioner. If the petitioner is having clean antecedent then his bail bond would be accepted otherwise he would be taken in custody.
