15-09-2017 Heard Sri Dhaneshwar Prasad Gupta, learned counsel for the petitioner and Smt. Asha Kumari, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 29-07-2017 in Rohtas P.S. Case No. 216 of 2017 registered for offence under Sections 30(a)/37(a)/34 of Bihar Prohibition and Excise Act, 2016 on an accusation of recovery of 5 liters of Mahua liquor and 20 Kg. of Mahua flowers, has prayed for grant of bail.

Learned counsel for the petitioner, besides arguing that petitioner has remained in custody for sufficient time, has referred to paragraph - 3 of the petition to show that petitioner is having clean antecedent.

Considering the nature of accusation, clean antecedent

Patna High Court Cr.Misc. No.42728 of 2017(2) dt.15-09-2017 2/2 as well as period of custody, let the petitioner namely Sudhir Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II cum Special Judge, Excise, Rohtas at Sasaram in connection with Rohtas P.S. Case No. 216 of 2017.
