Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 21-10-2021 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.
The petitioner prays for grant of anticipatory bail in Mehandiganj P.S. Case No. 82/2020 registered for the offence punishable under Sections 30(a)/36 of the Bihar Prohibition and Excise Act.
The petitioner has been named by co-accused from whom there is recovery of liquor.
Under the facts and circumstances of the case, this court is not inclined to grant anticipatory bail to this petitioner. It is, accordingly, rejected.
However, the petitioner is directed to surrender in the court below within one week and if he does not surrender within the
Patna High Court CR. MISC. No.38819 of 2020(3) dt.21-10-2021 2/2 aforesaid time, the Senior Superintendent of Police, Patna, is directed to take all coercive steps for arresting this petitioner as well as other accused persons involved in this case. The Senior Superintendent of Police, Patna should issue show-cause notice to the Investigating Officer of this case as to why the accused persons of this case have not been arrested till now by him though the case is of the year 2020 and, thereafter, inform this court about the steps taken for apprehending the accused persons and reasons as to why they were not apprehended by the police for such a long time and are doing illegal business of liquor.
The Senior Superintendent of Police, Patna, must submit compliance report to this Court within two weeks. A copy of this order be communicated to the Senior Superintendent of Police, Patna, forthwith through FAX for compliance of the order.
List this case after two weeks.
