Petitioners seek regular bail in connection with Desari PS Case No. 235 of 2021 registered under Sections 413 / 414 / 34 of the I.P.C.

One stolen Bolero vehicle has been recovered from the possession of the petitioners.

Learned counsel for the petitioners submits that petitioners have got no criminal antecedent and they have falsely been implicated in this case by the Police due to oblique motive. He next submits that the fact of the matter is that coaccused / Ratnesh Kumar @ Kallu represented the petitioners that the Bolero vehicle in question was On Sale and persuaded

No.53402 of 2021(2) dt.12-05-2022 2/2 them to meet the owner of the vehicle for finalization of its price and on that representation and information the petitioners boarded the vehicle in order to meet its owner but in the meanwhile the vehicle was intercepted by the Police and the petitioners were found sitting therein. Petitioners are having no criminal antecedent, they are in custody since 4/7/2021 and charge sheet has already been submitted.

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioners have got no criminal antecedent and charge sheet has already been submitted, as such, I am inclined to grant regular bail to the petitioners. Let the petitioners, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XVth Vaishali at Hajipur in connection with Desari PS Case No. 235 of 2021. (Anil Kumar Sinha, J) praful/- U T
