JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2017 The case has been listed today under the heading " To Be Mentioned" at the instance of learned counsel for the petitioner.

It has been submitted that vide order dated 27.07.2017 passed in this case, the bail application was disposed of with direction to court below to release the petitioner after verification of the fact that save and except confessional statement there is nothing against the petitioner. However, it is submitted that while arguing the said case no such submission was made by him and it has inadvertently been recorded in the said order and as a matter of fact that submission of learned counsel for the petitioner was that he was named in this case by the witnesses in para 10 and 11 of the case diary only on the basis of suspicion.

Patna High Court Cr.Misc. No.34492 of 2017 (3) dt.22-08-2017 2/2 Considering the facts and circumstances of the case and the submission of learned counsel for the petitioner, order dated 27.07.2017, is modified to the extent that submission made in para - 2 of the said order be read as "his name surfaced in this case on the basis of statement of witnesses in para 10 and 11 of the case diary".

The court below is directed to release the petitioner on bail and other conditions mentioned in the said order shall remain intact.

Let this order be communicated to the court below forthwith.
