JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-03-2021 Heard Mr. Arjun Prasad, learned Counsel for the petitioner and Mr. A. L. Pandit, learned Additional Public Prosecutor for the State, through Video Conferencing. This application, for grant of regular bail, arises out of Khodawandpur Police Station Case No. 177 of 2020, disclosing offences under Section 372/273/34 of the Indian Penal code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
The allegation, as per the First Information Report is that police raided the house of one Vikki Rawat and arrested co-accused as well as petitioner, who is wife of Vikki Rawat and recovered a total quantity of 977.51 litres of illicit liquor from their house.

No.4013 of 2021(2) dt.22-03-2021 2/3 Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case merely because the illicit liquor has been recovered from the house of coaccused, who happens to be her husband. Learned counsel next submits that the petitioner has got no criminal antecedent and the co-accused, i.e, husband of the petitioner Vikki Rawat has been granted bail by this Court in Cr. Misc. No.3669 of 2021. Learned counsel next submits that petitioner is in custody since 05.09.2020.
Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that co-accused Vikki Rawat, who is the husband of the petitioner, has been granted bail by a Coordinate Bench of this Court and the petitioner is in custody since 05.09.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, Kavita Devi, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise Act, Begusarai, in connection with Khodawandpur Police Station Case No. 177 of 2020.
