1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act and later on Section 411 of the I.P.C. was also added.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of one case and is in custody since 28.01.2024 and charge-sheet has been submitted. It is further submitted that co-accused Amit Kumar and Harish had approached this Court seeking anticipatory bail by filing Cr. Misc. No.44539 of 2024 and the same was allowed by an order dated 13.08.2024. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that a gun and

4. Learned A.P.P. opposes the bail application.

5. Considering the submissions made by the learned counsel appearing on behalf of the petitioner and the fact that charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Atri P. S. Case No.23 of 2024.

6. The application stands allowed.
