Petitioner seeks regular bail in connection with Khagaria Rail PS Case No. 13 / 2021 registered under Section 414 of the IPC and Sections 137 & 147 of the Railway Act . As per the prosecution case from platform no. 2 of Khagaria Railway Station one person got down from train no. 03246 DN and was running towards wrack point. The RPF personnel on suspicion stopped that person and upon search recovered 05 mobiles along with several SIM and cash of Rs. 150/-. The accused person disclosed that mobiles recovered from him are stolen articles.
Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and he has falsely been
Patna High Court CR. MISC. No.52209 of 2021(2) dt.22-04-2022 2/2 implicated by the Police. He further submits that on the basis of allegation made in the FIR Sections 137 & 147 of the Railway Act shall not be made applicable. Petitioner is in custody since 11-06-2021 and charge sheet has already been submitted. Regard being had to the submissions made by the parties and taking into consideration the material available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 11.06.2021 and charge sheet has already been submitted, as such, I am inclined to grant regular bail to the petitioner.
Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-Railway, Khagaria in connection with Khagaria Rail PS Case No. 13 / 2021.
