2. The petitioner apprehends his arrest in Hussainganj P.S. Case No. 92 of 2022 registered for the offences punishable under Section 302, 120, 120(B), 307 of the Indian Penal Code and Section 27 of the Arms Act, pending in the Court of learned A.C.J.M., IX, Siwan.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.42806 of 2023(3) dt.11-09-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that similarly situated co-accused has been granted regular bail.
