The petitioners seek bail in a case registered under Sections 124(A), 120(B) of the Indian Penal Code and Sections- 13, 16(B), 18, 20, 21 U.P.A. Act.

The prosecution case in short is that two papers each bearing "Gantantra Diwas Murdabad" written on it, were recovered from the petitioners.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 26-01-2018.

Patna High Court CR. MISC. No.42179 of 2019(2) dt.11-07-2019 2/2 Charge sheet has already been submitted. General and omnibus allegation has been made against the petitioners. The petitioners have been made accused in the present case due to mistake of fact. The other co-accused with similar allegation have been granted bail by a coordinate bench of this court vide order dated 28-06-2019 passed in Cr. Misc. No. 39099 of 2019. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIIth, Gaya in connection with Anti P.S. Case No. 05 of 2019.
