The petitioner apprehends her arrest in Aurangabad Town P.S. case No. 124 of 2011 under Section 420, 467, 468 and 120B of the Indian Penal Code.
The informant lodged complaint case No. 51 of 2011 on the basis of which the present FIR was lodged. The informant named the petitioner and alleged that petitioner was a Regional Director of the O.C.P.L. Company. The informant alleged that he deposited Rs. 3,25,000/- of different persons in the Company but the money was not returned.
It is submitted that petitioner is wife of accused No.4, Haribansh Singh, who is said to be the Executive Director of the O.C.P.L. Company. The petitioner is not a Regional Director of
Patna High Court Cr.Misc. No.31376 of 2016 (3) dt.15-09-2016 2/2 the Company. She is a lady and no specific allegation is made against the petitioner in the entire complaint petition. The petitioner neither received any amount nor persuaded the informant or any account holder to deposit any amount in the Company.
The learned Additional Public Prosecutor did not dispute the facts.
Considering the facts aforesaid and the fact that no specific allegation is made against the petitioner, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Aurangabad Town P.S. Case No. 124 of 2011, arising out of Complaint case No. 51 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
