The petitioners seek bail in S.K. Puri P.S. Case No. 336 of 2018, instituted for the offence under Section (s) 379 of the Indian Penal Code. Subsequently, Section 411/34 of the Indian Penal Code was added.
It is alleged in the written report that Motorcycle of the informant bearing registration No. BR-1BW-8838 which
Patna High Court CR. MISC. No.40729 of 2019(2) dt.05-07-2019 2/2 was parked at Sahdev Mahto Marg in front of Creative Kadahi, was stolen away by unknown person.
Counsel for the petitioners submits that petitioners are not named in the written report. They have been remanded in the instant case from Kotwali P.S. Case No. 896 of 2018. He further submits that petitioners are in custody in the instant case since 23.2.2019.
There is no recovery of any Motorcycle from possession of the petitioner.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Praveen Kumar Singh, learned Judicial Magistrate-1st Class cum Special Judge, C.B.I.
