JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-07-2017 The petitioner seeks regular bail in connection with Sherghati P.S. Case No. 201 of 2017, registered for offences punishable under Sections 379 of Indian Penal Code. Petitioner is not named in the F.I.R and it appears from the impugned order that informant in his restatement has named the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and he is next door neighbour of the informant. Further he has been in judicial custody since 21.04.2016 and has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not

Patna High Court Cr.Misc. No.34485 of 2017 (2) dt.27-07-2017 inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the petitioner may renew his prayer for bail after framing of charge or after remaining in further three months in judicial custody, whichever is earlier.
