JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-10-2017 The petitioner seeks regular bail in connection with Dumaria P.S. Case No. 11 of 2015, registered for offences punishable under Sections 147, 148, 149, 332, 333, 307, 353, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. And Section 17of CLA Act.

Allegation against the petitioner is of firing on the police party, who have raided the place in search of Maoists and petitioner is named in the F.I.R.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and no specific allegation has been made and he has been in judicial custody for last ten months.

Heard learned APP also.

Patna High Court Cr.Misc. No.46790 of 2017 (2) dt.11-10-2017 Having heard both sides, considering the fact and circumstances of the case and nature of allegation and also the fact that petitioner is named in the F.I.R and he is accused in eight more cases of similar nature, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the trial court is directed to expedite the commitment of the case and after commitment try to conclude the trial as soon as possible preferably within a period of nine months. (Vinod Kumar Sinha, J) sunil/- U T
