Petitioner apprehends his arrest in a case filed under Sections 186/409/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that he worked at the concerned place till 10.12.1999 as he was transferred to East Champaran, Motiharti and he had joined there in the month of December, 1999 itself. Thereafter, the work concerned continued till 2003. It is contended by appending Annexure 3 that the entire money which was received by him by cheque was transmitted to Junior Engineer, Mohan Sah described therein. It is also contended that one of the Junior Engineer,
Patna High Court Cr.Misc. No.47131 of 2015 (4) dt.02-03-2016 2 / 2 Udayanand Jha was granted anticipatory bail vide order dated 18.08.2004 passed in Cr. Misc. No.15038 of 2004. It is further contended that the petitioner did not know regarding the first information report having been lodged against him and even after lodgment of the case, he remained in service and worked but nobody had informed him regarding that.
Having regard to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Sonbarsa P.S. case no.95/2003, the above named petitioner, Shivdhar Ram shall be released on bail on furnishing bail bond of Rs.10,000 ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
