The petitioner apprehends his arrest in a case registered for the offence under Sections 120(B), 419, 420, 34 of the Indian Penal Code.

As per the prosecution case, petitioner alongwith other co-accused persons are alleged to have cheated the informant.

It is submitted on behalf of petitioner that so far as this petitioner is concerned, he has been made accused simply because he is son of co-accused Asha Devi. The money was transferred in the account of co-accused Asha Devi and Manoj Kumar Sah. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.52609 of 2021(4) dt.30-08-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur (Babarganj) P.S. Case No. 259 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
