30-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Karpi P.S. Case No. 161 of 2019, registered for the offence under Section 307/34 of the Indian Penal Code, which was converted to Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, while the informant (decease) was going from his house, on way, three accused caused fire-arm injury to him. The informant identified one of them as Pranam Sharma and during course of treatment, the informant died.

It is submitted on behalf of petitioner that name of the petitioner has come during course of investigation on the basis of confessional statement of co-accused Pranam Sharma. Similarly situated co-accused Amaresh Sharma, whose name

Patna High Court CR. MISC. No.52291 of 2021(2) dt.30-11-2021 2/2 also came in the confession of co-accused Pranam Sharma, has already been granted bail by a coordinate Bench of this Court, vide order dated 30.09.2021 passed in Cr.Misc. No. 27260 of 2021. Petitioner is in custody since 20.05.2020. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII Jehanabad in connection with S. Tr. No. 05 of 2021, arising out of Karpi P.S. Case No. 161 of 2019.
