The petitioner seeks bail in a case instituted under Sections 304B, 494, 498A, 201/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Allegation against the petitioner is of committing murder of the daughter of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody 22.8.2017 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is the Gotani of the deceased. She is separate in mess and property from the husband of the deceased. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is ordered that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Fast Track Court No.II, Madhepura in connection with Murliganj P.S. case No.44 of 2004 (G.R. No.351 of 2004), Sessions Trial No.116A of 2005.
