2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.
3. Allegation against this petitioner is to assault the informant with iron rod on the head causing him injury.
4. Learned counsel for the petitioner submits that both parties are close relatives and due to petty dispute scuffle took place between them. There is delay of 5 days in lodging of the F.I.R. which itself creates doubt about the prosecution case. Doctor has reserved opinion with regard to the nature of injury. Petitioner has got clean antecedent.
5. Considering the backdrop of the case and clean antecedent, this anticipatory bail is allowed and it is ordered that
Patna High Court CR. MISC. No.43073 of 2023(3) dt.25-09-2023 2/2 let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Dalsingh Sarai in connection with Dalsingh Sarai P.
