Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sursand P.S. Case No. 28 of 2020, lodged under Sections 394 of the Indian Penal Code.

As per prosecution, the present case has been lodged against 3 unknown accused persons, against whom allegation of committing robbery and snatching of Rs.55,000/- on gun point is there in the F.I.R., in which they also fired on brotherin-law (Sadhu) of the informant namely Baiju Prasad. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He

No.42627 of 2022(2) dt.06-12-2022 2/3 further submits that antecedent of petitioner is clean and the name of petitioner has figured in this case by virtue of confessional statement of one Amit Kumar whose name has come on the basis of suspicion in this case. He also submits that nothing incriminating has been recovered from the possession of petitioner nor he was put on T.I.P. Learned counsel for the petitioner further submits that petitioner is in custody since 25.05.2022 and charge sheet has already been filed in this case. He further submits that the person on whose confession the name of petitioner has figured has already been granted bail by the Co-ordinate Bench of this Court vide order dated 05.01.2021 passed in Cr. Misc. No. 32300 of 2020. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupari Sitamarhi in connection with Sursand P.S. Case No. 28 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
