JUSTICE RAVI RANJAN ORAL ORDER 11-07-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 308, 354, 379, 427, 504/34 of the Indian Penal Code. It is contended on behalf of the petitioners that the alleged occurrence is outcome of the dispute between the parties for a piece of land which would be apparent from the FIR itself which was lodged two days after the date of occurrence. It is further contended that the allegation against the petitioner no.2 is to have assaulted the informant by knife but no injury caused by sharp cutting weapon has been found as the injury found upon her is

Patna High Court Cr.Misc. No.26355 of 2016 (2) dt.11-07-2016 2/2 simple in nature caused by hard blunt substance. So far other persons are concerned, practically no injuries are found upon them.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Ram Chandra Das, Lalita Devi, Sunita Devi @ Anita Devi, Mina Devi @ Sarita Devi, Tala Devi and Sarita Devi be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Warisnagar P.S. Case No.50/2016, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
