Petitioner apprehends his arrest in a case filed under Sections 409 and 420/34 of the Indian Penal Code. As per allegation, the petitioner has taken six thousand rupees as bribe from one Shrawan Kumar but did not provide him Indira Awas.

It is contended on behalf of the petitioner that mother of the complainant was already given Indira Awas in the year 2001-02 itself and now he was trying to change the name of the mother and again tried to take advantage of Indira Awas but it was not given to him, therefore, such wild allegation without any foundation has been made against the petitioner.

No.26383 of 2016 (2) dt.11-07-2016 2 / 2 Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Tekari P.S. case no.127/2016, the above named petitioner, Mritunjay Kumar shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
